Terms of Service

Adventure Japan is a Platform that lets users quickly discover adventure tours and Experiences across Japan, allowing users to make reservations and payments. Adventure Japan provides a service that matches users with tours and Experiences and facilitates Bookings and payments. Please note that the operating company, Region Design Inc., is not a travel agency, travel agent, or travel arrangement service provider. When users make a reservation through Adventure Japan, they enter into a direct Booking with the third party offering the tour or Experience.

Use of Adventure Japan’s Services is subject to these Terms of Service. These terms outline the User legal rights, limitations on those rights, and provisions regarding governing law and jurisdiction for dispute resolution.

Introduction

1.1 The terms outlined here, along with our Privacy Policy (collectively referred to as the “Terms of Service”), set the conditions under which Region Design Inc. (“we” or “us”) provides Services (the “Services”) through the Adventure Japan Booking Platform (the “Platform”). The Services are accessible through our Website (https://www.Adventure Japan.jp, including associated sites, applications, and others, collectively called the “Website”) and by phone. “User” refers to any individual accessing or using the Services. We are not a travel agency, travel agent, or travel arrangement service provider, nor do we directly provide tours, activities, or Experiences. Users agree with an independent third-party provider through our Platform when making a reservation.

1.3 These Terms of Service define the relationship between the User and us regarding the use of our Services, including Bookings for tours, tickets, attractions, activities, and Experiences (collectively referred to as “Experiences”) offered by third-party providers and advertised on our Website (each referred to as a “Product”).

1.4 By using or accessing the Services, making a Booking (“Booking”), or making a payment, the User agrees to, understands, and accepts these Terms of Service. When making a Booking, the individual Booking on behalf of others listed in the reservation is deemed to accept these Terms on behalf of everyone included in the Booking.

1.5 We reserve the right to amend these Terms of Service anytime. Following such changes, continued access to or use of the Services constitutes acceptance of the revised Terms of Service. We will list the date of the latest update at the top of this page, and the revised Terms will be effective immediately upon posting.

Use of Services

2.1 When using the Services provided by Adventure Japan, Users confirm and guarantee that (i) all information provided while using the Services is true, accurate, current, and complete, and (ii) the User is at least 13 years of age. Adventure Japan does not knowingly collect information from individuals under 13.

2.2 Users’ access to the Services is strictly limited to personal, non-commercial use and legitimate inquiries or Bookings for the listed Products. Users agree not to use the Services for speculative, false, or fraudulent requests or Bookings.

2.3 Users further represent and warrant that (a) they have not previously had their access to the Services suspended or prohibited by Adventure Japan, (b) they are not using the Services on behalf of any competitor of Adventure Japan, and (c) they have the legal right and authority to enter into this binding agreement, which does not violate any other agreements they may be bound to.

2.4 We reserve the right, at our sole discretion, to deny access to the Services to any individual at any time, including but not limited to cases of violations of these Terms of Service.

2.5 Users may encounter content they find offensive, inappropriate, inaccurate, or objectionable by accessing or using the Website. Adventure Japan tries to prevent such content from being displayed. However, Users access and use the Website at their own risk.

Prohibited Activities on the Website

3.1 The content and information on the Website (including, but not limited to, messages, data, information, text, music, sound, photos, graphics, video, maps, icons, software, code, or other material, collectively referred to as “Website Content”) and the infrastructure used to provide such content are owned by us. Users agree not to modify, reproduce, distribute, transmit, display, perform, copy, publish, license, create derivative works from, transfer, sell, or resell any Website Content, Products, or Services obtained from or through the Website. Any other use of Website Content, Products, and Services requires our prior written permission.

3.2 Users agree not to perform or enable others to perform the following actions:

  1. Use the Website or Website Content for commercial or unlawful purposes.
  2. Use robots, spiders, scrapers, or other automated or manual processes to access, monitor, or copy Website Content or to access, scrape, index, retrieve, or otherwise use the Website or Website Content for any purpose without our express written permission.
  3. Violate the restrictions in the robot exclusion headers on the Website or bypass or circumvent other measures to prevent or restrict access to the Website.
  4. Take actions that impose an unreasonable load on our infrastructure or make excessive traffic requests to the Website.
  5. Deep-link to any portion of the Website without our express written permission.
  6. Frame, mirror, or otherwise incorporate any part of the Website into another Website without our prior written consent.
  7. Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse-engineer any software used on the Website.
  8. Use the Website to threaten, stalk, defraud, incite, harass, or interfere with another person’s use of the Website.
  9. Send or transmit spam, chain letters, contests, junk email, pyramid schemes, surveys, or other mass messaging on the Website, whether of a commercial nature or not.
  10. Use the Website in a way that creates a conflict of interest, such as by exchanging reviews with other business owners or soliciting or writing reviews.
  11. Use the Website to promote bias or discrimination against protected classes.
  12. Use the Website to infringe on third-party rights, including, but not limited to, breaches of trust, copyrights, trademarks, patents, trade secrets, moral rights, privacy rights, publicity rights, or other intellectual property or proprietary rights.
  13. Use the Website to submit or transmit pornographic or illegal content.
  14. Use the Website to solicit personal information from minors or to harm or threaten to harm others, including minors.
  15. Attempt unauthorized access to the Website, user accounts, computer systems, or networks connected to the Website through hacking, password mining, or other means.
  16. Use the Website to transmit any computer Viruses, worms, defects, Trojan horses, or other items of a destructive nature (collectively, “Viruses”).
  17. Use any device, software, or routine to interfere with the proper functioning of the Website or otherwise attempt to interfere with the Website’s operation.
  18. Use the Website to breach the security of computer networks or crack passwords or security encryption codes.
  19. Interrupt or disrupt the security of the Website or otherwise harm the Website.
  20. Remove, circumvent, disable, damage, or interfere with any security-related features of the Website or features that prevent or restrict the use or copying of Website Content or enforce limitations on the use of the Website.

Electronic Communication

4.1 When using the Adventure Japan Website or sending emails, text messages, or other communications from a desktop or mobile device, you communicate with us electronically. You consent to receive communications from us in various forms, including email, in-app push notifications, or notices posted on the Website. You may opt out of marketing-related emails by emailing specific unsubscribe addresses provided by Adventure Japan; however, we may still send non-marketing messages related to future Bookings.

4.2 As part of our Services, we may share information within our group of companies to provide you with special offers, Product, and service information. We generally send this information through newsletters or marketing communications. This is part of our effort to better understand your preferences regarding our Services and those of affiliated companies. It allows us to tailor our Services more closely to your interests.

Content

5.1 Users and others can contribute to the Adventure Japan Website in various ways, such as by sending emails, creating reviews, making posts, uploading photos or videos, posting comments, suggesting ideas, completing public profiles, and rating posts (collectively referred to as “User Content”). We may use User Content in multiple ways, including displaying it on the Website, reformatting it, translating it into other languages, editing for clarity or grammar, incorporating it into advertisements or other works, creating derivative works, promoting, distributing, and allowing others to do the same on their websites or media Platforms.

5.2 By submitting User Content, Users grant Adventure Japan and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, transferable, irrevocable right to (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from, and publicly display and perform such User Content for any purpose in any media; and (b) use the name submitted in connection with such User Content. Users acknowledge that Adventure Japan may choose to provide attribution for User Content at its discretion and grant Adventure Japan the right to take legal action against anyone violating these Terms or infringing on Adventure Japan’s rights in User Content. Users agree that User Content is non-confidential and non-proprietary. If Users retain moral rights (including rights of attribution or integrity) in their User Content, they: (a) waive any right to require that personal information be used in connection with the User Content or its derivative works, upgrades, or updates; (b) agree not to object to Adventure Japan or its licensees’, successors’, or assignees’ use, modification, deletion, or exploitation of the User Content; (c) waive and will not claim any author’s moral rights in User Content; and (d) release Adventure Japan and its licensees, successors, and assignees from any claims based on such moral rights.

5.3 Adventure Japan and its affiliates may display advertisements and other information alongside or included with User Content on the Website. Users have no right to any compensation for such advertisements. The methods, forms, and extent of advertising are subject to change without prior notice.

5.4 The Website may include discussion forums, bulletin boards, review Services, or other interactive areas where Users or others can post User Content. Users use such areas at their own risk and responsibility. By using interactive areas, Users agree not to post, upload, transmit, distribute, store, create, or otherwise publish through the Website any User Content that:

  1. is unlawful, defamatory, libelous, obscene, pornographic, inappropriate, vulgar, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable;
  2. promotes criminal activities, infringes any party’s rights, or violates the law in any other way;
  3. infringes any patent, trademark, trade secret, copyright, or other intellectual or proprietary rights;
  4. impersonates any person or entity or misrepresents User affiliation with any person or entity;
  5. is related to promotions, political campaigns, advertisements, contests, or solicitations;
  6. includes third-party private information, such as addresses, phone numbers, email addresses, social security numbers, or credit card numbers;
  7. contains Viruses, corrupted data, or other harmful files;
  8. is unrelated to the topic of the posted interactive area;
  9. violates the above conditions or is deemed offensive or harmful by Adventure Japan.

5.5 Users are solely responsible for the User Content they submit. Users bear all risks associated with the User Content, including its accuracy, completeness, or usefulness, and the disclosure of any personal information in User Content. Users represent that they own or have permission to use and authorize the use of User Content as described herein.

5.6 Adventure Japan and its affiliates assume no responsibility or liability for User Content posted, stored, or uploaded by Users or any third party or for any loss or damage related to such content. Adventure Japan is not responsible for errors, defamation, omissions, falsehoods, obscenity, pornography, or profanity Users may encounter.

5.7 Although Adventure Japan is not obligated to screen, edit, or monitor User Content, it reserves the right, at its discretion, to remove, screen, or edit any User Content at any time and for any reason without notice. Users are responsible for creating backup copies of their User Content at their expense. Adventure Japan is not obligated to retain or provide copies of User Content. It does not guarantee confidentiality of User Content.

5.8 Use of interactive areas or other parts of the Website in violation of these terms may result in suspension or termination of access to the interactive areas and the Website.

Links to Third-Party Websites

6.1 The Adventure Japan Website may contain hyperlinks to websites operated by third parties outside Adventure Japan. These are called “Third-Party Sites” and are provided solely for Users’ convenience. Including hyperlinks on our Website does not imply endorsement of the material on these Third-Party Sites, nor any association between Adventure Japan and their operators.

6.2 We do not control these Third-Party Sites. We are not responsible for their content or the privacy or other practices of the companies, organizations, or entities that own or operate them.

6.3 Users are responsible for ensuring that any hyperlink they follow or software they download (from our Website or Third-Party Sites) is free of Viruses or other harmful elements.

6.4 Users may encounter options on Third-Party Sites to link an Adventure Japan profile to a profile on that site. This linking is entirely voluntary. If Users choose to set up such a link and later wish to turn it off, they must contact the Third-Party Site directly.

Copyright and Trademark Notice

7.1 Except for third-party content, the Adventure Japan Website and all its contents—including visual interfaces, interactive features, custom graphics, design, computer code, compilation of Products, software, content (including third-party content), and other elements and components—are the property of Region Design Inc. All rights are reserved. Adventure Japan is not responsible for the content of websites operated by third parties. The names and slogans of other Products or Services displayed on the Website (including those for Products) are registered trademarks or common law trademarks of Adventure Japan and its suppliers or licensors and may not be copied, imitated, or used, in whole or in part, without prior written permission from Adventure Japan or the respective trademark owner. Additionally, the look and feel of the Website, including all page headers, custom graphics, button icons, and scripts, are service marks, trademarks, and trade dress of Adventure Japan and may not be copied, imitated, or used in whole or in part, without prior written permission. Other trademarks, registered trademarks, Product names, company names, and logos mentioned on the Website are the property of their respective owners. Mention of any trademark, registered trademark, manufacturer, Supplier, Product, service, or other information does not constitute or imply endorsement, sponsorship, or recommendation by Adventure Japan.

7.2 If you become aware of any infringement of your or our brand, please follow the instructions on our Website to contact us.

Product Reservations and Bookings

8.1 Adventure Japan provides a Platform to facilitate agreements between users and third-party Product providers (“Suppliers”). Adventure Japan is not a supplier of any Products, and the contract for supplying Products booked by Users is entered directly between the User and the respective Supplier. For each Booking, Adventure Japan acts as a disclosed agent on behalf of the Supplier, and the listing of Products constitutes a User offer to the Supplier. On behalf of the Supplier, we reserve the right to accept or reject such offers. These Terms regulate the use of the Services, including the Platform through which such offers may make to Suppliers. However, the supply of the Products booked by Users is subject to the terms displayed on the Website, the information provided during the Booking process, and the Supplier’s terms governing the provision of the Product.

8.2 When Booking, Users agree to review and adhere to the Supplier’s terms and conditions and any other rules and policies related to the Product (“Supplier’s Terms”). Notwithstanding the above, if there is a conflict between the Supplier’s Terms and these Terms regarding the User legal relationship with Adventure Japan, these Terms shall take precedence. Users undertake their own risk for all interactions with Suppliers. Adventure Japan is not responsible for any actions, omissions, errors, representations, warranties, breaches, or negligence by Suppliers or for any resulting personal injury, death, property damage, or other damages or expenses arising from interactions with Suppliers.

8.3 Adventure Japan is not a travel agency, travel agent, or travel service arrangement company. It does not directly provide or own any Experiences. Adventure Japan facilitates Booking and includes information about Products on the Website. However, such actions do not imply endorsement, approval, or partnership between Adventure Japan and Suppliers. Users of Adventure Japan may review and rate specific Products based on their Experiences. However, Adventure Japan does not endorse any Products. Users agree that Adventure Japan is not responsible for the accuracy or completeness of information obtained from Suppliers or displayed on the Website.

8.4 By Booking, Users warrant that they are at least 18 years old, have the legal authority to enter into this binding agreement and a binding agreement with the Supplier, and that all information provided is true and accurate. Additionally, Users agree to use the Platform solely to make legitimate Bookings for themselves or others they legally authorize to act.

Pricing

9.1 The price for each Product is displayed per person unless otherwise specified.

9.2 Prices are based on local rates at the time of the quote and converted using the prevailing exchange rate determined by Adventure Japan. For details on currency conversion, see Section 10.

9.3 Price estimates are subject to change only after the Booking is confirmed.

9.4 Unless expressly stated by the Supplier, prices do not include local taxes or fees, such as departure, security, port, park, customs, immigration, agriculture, passenger facility fees, and international transportation taxes.

9.5 The Supplier determines the Inclusions. Prices do not cover tips/gratuities, passport and visa fees, baggage and personal insurance, personal items, or any food and beverages not expressly included by the Supplier.

Payment

10.1 When making a Booking, Adventure Japan collects the User payment information and processes the payment as described in Section 12. In this process, Adventure Japan acts as the Supplier’s limited payment collection agent, collecting payment on behalf of the Supplier for the applicable Product. Unless otherwise specified, full credit or debit card payment is required to complete the Booking. The payment recipient will appear as Adventure Japan on the credit or debit card statement.

10.2 The value of the User Booking may be subject to taxes, duties, foreign transactions, currency exchange, or other fees. The User bank or payment card provider may convert the payment to the local currency and charge additional fees, resulting in a difference between the amount displayed on the Platform and the final amount charged. Adventure Japan recommends contacting the User bank or card provider for questions regarding currency conversion or applicable fees.

Payment Processing

11.1 Under these Terms of Service, payment processing Services for Adventure Japan are managed by Region Design Inc., the operating company of Adventure Japan, or the appropriate subsidiary or affiliate, depending on the payment method used for the User Booking. Region Design Inc.’s registered office is in Tokyo, Japan.

11.2 If a Booking using a credit or debit card and the payment process is via an European acquirer or another international payment processor, Region Design Inc. provides the payment processing Services or the appropriate affiliate, as will appear on the User card statement. For Bookings made with other payment methods, the payment processing Services are provided by the designated subsidiary or affiliate of Region Design Inc., as noted on the applicable payment statement. Depending on the entity processing the User payment, these Terms constitute an agreement between the User and the relevant entity of Region Design Inc. For clarity, these Terms do not constitute an agreement between the User and any unrelated third-party payment processor.

Changes or Cancellations by the User

12.1 After purchasing a Product, changes or cancellations to the reservation by the user are non-refundable unless otherwise specified in the terms and conditions applicable to that Product.

12.2 Under the standard cancellation policy, you may request to change or cancel your reservation up to 24 hours before the scheduled start time. Suppose the Experience does not have a specific start time. In that case, the deadline to request a change or cancellation is generally calculated based on Japan Standard Time. It is 11:59 PM, two days before the start date.

12.3 If a Product designate as “Final Sale” or similar wording is used (including, but not limited to, all group Bookings made through our group Booking department), it is non-refundable. You cannot make changes or cancellations after Booking. Some Products may have different cancellation policies. Always check the cancellation policy included in the Product listing at the time of Booking, as this policy governs your conditions for cancellation and refunds.

12.4 Adventure Japan processes all change requests based on the applicable Supplier’s availability and consent. Adventure Japan does not guarantee the success of any change request. If the Supplier is unable or unwilling to accept the change request, your right to a refund (if any) will be governed by the cancellation terms of your Booking.

12.5 If you made a reservation using a promotional code or accepted a discount or special offer price during checkout, making a change request after Booking may invalidate your discount or special offer price.

12.6 No refunds are available once the Experience has commenced or if any package, accommodation, meals, or other Services have utilized.

Other Changes and Cancellations

13.1 Suppliers may modify Product details such as dates, prices, inclusions, coverage, age requirements, or other characteristics or requirements of the Product after purchase. Consequently, Adventure Japan reserves the right, on behalf of the Supplier, to cancel, modify, or substitute any purchased Product at any time. Suppose the Supplier proposes a significant change (such as a schedule change or substantial alteration to the itinerary), and the User is unsatisfied with the alternatives provided. In that case, a full refund of the original purchase price entitle.

13.2 at our sole discretion, we may withdraw Services if deemed necessary or desirable to protect the interests of Adventure Japan, the Supplier, and the User. It may override the Product’s cancellation policy, effectively canceling the Booking. At our sole discretion, we may also choose to refund part or all of the amount charged to the User. Users agree that neither Adventure Japan nor the applicable Supplier shall be liable for any such cancellations or refunds.

Our Liability

14.1 Please read this section carefully, as it limits Adventure Japan’s liability to Users for issues that may arise concerning the use of the Services. If you do not understand any of the provisions in this section or elsewhere in these Terms, consult a legal professional before accessing or using the Services.

14.2 The information, content, software, Platform, and Services provided by Adventure Japan may need to be corrected, including those related to availability and Booking pricing. Adventure Japan and its parent, subsidiaries, and affiliates (collectively, “Takumi Adventures Group Companies”) disclaim any responsibility for errors or inaccuracies related to information and descriptions of Products or other Services (including but not limited to pricing, availability, photos, features, inclusions and exclusions, general descriptions, reviews, and ratings). Additionally, Takumi Adventures reserves the right to correct any availability and pricing errors and errors related to Bookings made at an incorrect price.

14.3 Region Design and its affiliates make no representations regarding the suitability of information, content, software, Platform, Products, or other Services for any purpose. Offering or listing a Product or service does not constitute an endorsement or approval by Adventure Japan Group Companies. All information, content, software, Platforms, Products, and Services provide “as is” without warranties. Region Design and its affiliates disclaim any warranties or conditions regarding the Platform’s absence of Viruses or other harmful components. To the fullest extent allowed by law, Adventure Japan disclaims all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement related to this information, content, software, Platform, Products, and Services.

14.4 Suppliers act as independent contractors, not as agents or employees of Region Design or its affiliates. Region Design and its affiliates bear no liability for any acts, errors, omissions, representations, warranties, breaches, negligence, or misconduct by such Suppliers, nor for any resulting personal injury, death, property damage, or other damages or expenses arising from Bookings or use of Products. Region Design and its affiliates are not responsible for delays, cancellations, over Bookings, strikes, force majeure events, or other circumstances beyond their control. They are not liable for any associated costs, omissions, delays, diversions, or actions by any government or authority.

14.5 Region Design and its affiliates (or their officers, directors, or affiliates) shall not be liable for any direct, indirect, punitive, incidental, special, exemplary, or consequential damages arising out of, or in connection with, Products, Bookings, or access to, display of, or use of the Services, regardless of the basis of the claim, whether based on negligence, contract, tort, strict liability, or other theories, even if Adventure Japan has been advised of the possibility of such damages.

14.6 If any Adventure Japan Group Company is found liable for any loss or damage related to the use of the Services, Bookings, or Products, the liability of Region Design and its affiliates shall not exceed, in any case, (a) the amount paid to Adventure Japan for the relevant Booking or (b) US $100.00, whichever is greater.

14.7 The liability limitations outlined in Section 14 reflect the allocation of risk between the parties. These limitations will apply even if any limited remedy provided in these Terms fails in its essential purpose. The liability limitations in these Terms benefit Region Design and its affiliates.

User Responsibility

15.1 Users agree to defend and hold harmless Adventure Japan, Region Design, their affiliates, and each of their respective officers, directors, employees, and agents from any claims, causes of action, demands, lawsuits, proceedings, investigations, losses, damages, fines, penalties, fees, expenses, costs, and any other liabilities, including reasonable legal and accounting fees, arising from or related to (i) a violation of these Terms or any referenced documents, (ii) a breach of laws, rules, regulations, or guidelines, (iii) an infringement, misuse, or violation of third-party rights, particularly publicity or privacy rights, (iv) the use of the Services (including the Website), (v) Booking or use of Products, or (vi) negligence or intentional misconduct by the User.

General Provisions

16.1 Users agree that nothing in these Terms of Service or using the Services creates a joint venture, agency, partnership, or employment relationship between the User and Region Design or its affiliates.

16.2 Adventure Japan’s performance under these Terms is subject to existing laws and legal processes. These Terms do not limit Adventure Japan’s right to comply with law enforcement or other government or legal requests for information related to using the Services or information provided to or gathered by Adventure Japan in connection with such use. To the extent permitted by applicable law, Users agree to bring any claim or cause of action arising from or related to access or use of the Services within two years from the date the claim or cause of action arose; otherwise, such claim or cause of action permanently waive.

16.3 If any part of these Terms is found invalid or unenforceable under applicable law, the invalid or unenforceable provision shall be replaced with a valid and enforceable provision that closely matches the intent of the original provision. The remaining provisions shall continue in effect.

16.4 These Terms (and any referenced terms and conditions) constitute the entire agreement between the User and Adventure Japan regarding the Services, superseding all prior or contemporaneous communications and proposals, whether electronic, oral, or written. A printed version of these Terms and any notices given in electronic form shall be admissible in judicial or administrative proceedings related to these Terms to the same extent and under the same conditions as other business documents and records.

16.5 Any rights not expressly granted herein are reserved.

Governing Law and Jurisdiction

17.1 These Terms of Service shall be interpreted by Japanese law.

17.2 For any disputes regarding the use of content under these Terms or matters related to these Terms, the local district court with jurisdiction over the location of the organization publishing the content or Terms shall have exclusive jurisdiction as the court of first instance.
